Petitioner has filed this petition under Section 482 Cr.P.C. for issuance of directions to respondent to look into the matter and proceed further and to take action as per law in case FIR No.25 dated 17.01.2014 under Section 365 IPC registered at Police Station Sector5, Gurgaon or in the alternative, in case the said FIR stands cancelled, about which the petitioner is not aware, the case may kindly be ordered to be reopened and further orders may kindly be issued to re-investigate into the matter so that truth may come out. I have heard learned counsel for the petitioner and have gone through the record.

The perusal of the record shows that FIR has already been registered but the petitioner is not knowing that as to whether the challan has been presented or whether cancellation report has been VINEET GULATI 2016.01.27 11:29 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-43488 of 2015 -2filed. A vague relief has been asked in the petition by stating that if FIR has been cancelled, about which the petitioner is not aware, then it can be ordered to be reopened.

Before filing this petition, the petitioner should have first known the facts whether the investigation is going on or whether any cancellation report has been filed or accepted or challan has been presented. A general and vague relief cannot be claimed. It is also not clear whether the petitioner is aggrieved from the investigation and wants proper and fair investigation.

In view of the above, as petitioner himself is not clear as to what is the stage of the case and what relief he wants, therefore, this petition is dismissed being vague in nature. However, the petitioner is at liberty to file fresh petition after giving correct and complete particulars of stage of the case.
