KARAMJIT SINGH , J. (Oral) Case has been heard through Video Conferencing in view of COVID-19 Pandemic.

Learned counsel for the petitioner has contended that the petitioner Paramjit Singh @ Tarsem Singh was declared innocent by the police during investigation of criminal case having FIR No.22 dated 10.02.2019 under Sections 120B, 363 and 366A of the Indian Penal Code and under Section 6/8 of the POCSO Act, 2012, registered at Police Station Bhindi Saidan, District Amritsar Rural. Accordingly, challan was presented in the Court in which, petitioner was placed under Column No.2, he being found innocent. However, despite this, the office of the Senior Superintendent of Police, Amritsar Rural has withheld the Police Character Certificate of the petitioner, which is immediately required by him to join the Indian Army as a Sepoy. It is further contended that the petitioner has already moved application (Annexure P-3) in this regard to the SSP, Amritsar Rural and even the Army authorities have also made request to the police, vide letter dated 24.07.2020 to verify the antecedents of the petitioner.

At this stage, Mr. Sukhbeer Singh, Assistant Advocate General, Punjab, accepts notice on behalf of the State. Learned counsel for the petitioner submitted that he would be satisfied if necessary direction is given to the concerned police authority to look into the matter relating to Annexure P-3 and Annexure P-6 and issue Police Character Certificate to the petitioner, at the earliest in a time bound manner.

Accordingly, this writ petition is hereby disposed of, without commenting on the merits of the case, with a direction to respondent No.2, i.e., SSP, Amritsar Rural, to consider and decide application (Annexure P-3) submitted by the petitioner and the copy of the letter (Annexure P-6) dated 24.07.2020 issued by Army Recruitment Office, Amritsar Cantt., in accordance with law, within 10 days from the passing of this order and to send its intimation directly to the aforesaid Army Recruitment Office. In the given circumstances, the concerned Army Recruitment Office may take a lenient view regarding delay in submission of Police Character Certificate of the petitioner.
