IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH

CRM-M-44458-2016 Date of decision: 03.08.2018 Baldev Singh ..... Petitioner

Versus

State of Punjab and others ..... Respondents

CORAM:

HON'BLE MR. JUSTICE RAMENDRA JAIN PRESENT: None for the petitioner.

Mr. Davinder Bir Singh, DAG, Punjab.

Mr. Lakhwinder Singh, Advocate for respondents No. 4 to 6. RAMENDRA JAIN, J. (ORAL) Power of Attorney filed on behalf of respondents No. 4 to 6, is taken on record. Office to tag the same at the appropriate place. Despite the case having been called twice, the petitioner has gone un-represented.

Perusal of the file shows that on the previous date also, none has put in appearance on behalf of the petitioner. On instructions from ASI Gurmukh Singh, learned State counsel submits that the instant petition has rendered infructuous, in view of the fact that earlier cancellation report filed by the police in this case was not accepted by the learned Magistrate. In compliance of the order of learned Magistrate, re-investigation was done. Again cancellation report was filed which has been accepted on 06.01.2018, by the learned Chief Judicial Magistrate, Gurdaspur.

In view of the above, the instant petition is dismissed as having rendered infructuous and for want of prosecution, as well.
