NIRMALJIT KAUR, J. (ORAL) The present petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in case FIR No.144 dated 16.07.2014, under Sections 406, 420 IPC, registered at Police Station Dakha, Ludhiana, pending trial.

It is stated that the petitioner was granted bail way back on 16.04.2015. Subsequently, on one of the dates he was not present and his bail bonds were accordingly cancelled. Thereafter, as the non-bailable warrants of the petitioner were received back unexecuted with the report that he was not found present at his premises, proceedings under Section 83 Cr.P.C. were initiated. It is stated that the petitioner had no intention to abscond. In fact, he was never served at the correct address, which is House No.643, Sector 8-B, Chandigarh and the warrants were sent on wrong MEENU 2020.08.13 14:10 I attest to the accuracy and authenticity of this document chandigarh

In view of the above, in case the petitioner appears before the trial Court within ten days from today and files his application for regular bail, he shall be released on bail on his furnishing of bail bonds and surety bonds to the satisfaction of the trial Court. Disposed of in the above terms.
