**** JAGMOHAN BANSAL , J. (Oral) The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking directions to respondent No.3-Divisional Security Commandant, Northern Railway, DRM Office Complex, Ambala Cantt, to release his retiral benefits.

Learned counsel for the petitioner inter alia contends that the petitioner was serving as Constable with respondent-department since 1988. The petitioner was transferred from Chandigarh to Saharanpur. The petitioner on account of medical condition of his son could not join his new place of posting and made representations to the authorities to reconsider his transfer. The services of the petitioner came to be terminated. The petitioner made various representations seeking release of his retiral benefits i.e. provident funds, General Insurance Fund and leave encashment. The petitioner has served legal notice still the respondent has not released his retiral benefits.

In view of statement of learned counsel for the respondents, the present petition is disposed of with a direction to respondent No.3 to decide claim of the petitioner qua retiral benefits within 06 weeks from today. If the respondent No.3 fails to do so, the petitioner would be at liberty to move an appropriate application for restoration of the present petition. It is further made clear that if respondent No.3 fails to pass order within stipulated time, an appropriate action would be initiated against the respondent No.3.
