State of Punjab

Coram:

Hon'ble Mr. Justice Inderjit Singh .....

Present:

Mr. Amandeep Singh, Advocate for the petitioner. .....

Inderjit Singh, J.

The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.62 dated 7.9.2012 registered for the offences under Sections 452, 324, 506, 379, 148 and 149 IPC at Police Station Haibowal, District Ludhiana as his bail bonds have been cancelled vide order dated 2.5.2014 passed by learned trial Court and his anticipatory bail application was dismissed by the learned Additional Sessions Judge, Ludhiana.

I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that earlier the petitioner was granted bail in this case, but he absented on 2.5.2014 from the trial Court and, therefore, his bail was cancelled and bonds were forfeited. A perusal of the record shows that the petitioner remained absent from the Court Harpal Singh Parmar 2016.12.17 11:57 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-44488 of 2016 [2] proceedings since 2.5.2014. It is in the order of the learned Additional Sessions Judge that the learned trial Court issued non-bailable warrants against him 27 times.

Keeping in view the conduct of the petitioner-accused and the fact that he misused the concession of bail granted to him earlier, I do not find it a fit case where the present petitioner is entitled to the benefit of anticipatory bail.

Therefore, finding no merit in this petition, the same is dismissed.

December 15, 2016.
