**** ANITA CHAUDHRY, J(ORAL) This is the third petition filed by the petitioner seeking regular bail in FIR No. 135 dated 12.10.2015 registered at Police Station Chabbewal, District Hoshiarpur under Sections 306 IPC. The first bail application was dismissed on merits in August 2016.

Counsel for the petitioner refers to 'K.V.Prakash Babu versus State of Karnataka, Criminal Appeal No(s). 1138-1139 of 2016' and urges that if the husband is having an extra marital affair that by itself will not be enough to record a conviction.

The merits of the case are not to be gone into. The prayer for the petitioner had been rejected on merits. There is no change in the circumstances. The authority referred to is not applicable.
