**** RITU BAHRI , J. (Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No. 67, dated 21.06.2014, registered at Police Station Chohla Sahib, Tarn Taran District Tarn Taran , who has been booked for having committed the offence punishable under Sections 306/120-B IPC. The allegation against the present petitioner that he and his family members are harassing the complainant's daughter Amarjit Kaur on account of bringing less dowry and further that the complainant's family had not served nonvegetarian to the petitioner and his family members in marriage, due to which the daughter of the complainant Amarjit Kaur jumped into the canal and died.
After going through the contents of the challan (P-3), it was transpired that the complainant being Amritdhari Gursikh did no serve the baraat at the time of marriage with nonGAURAV 2015.01.27 11:24 I attest to the accuracy and integrity of this document
Crl. Misc.No. M-43684 of 2014 (O&M) -2vegetarian food. The marriage was solemnized in the year 2007. The petitioner had a dispute with his wife with regard to using or operating a sim card for making telephone calls. The challan had been presented on 24.09.2014.
Learned State counsel on instructions submits that the challan is yet to be presented and there are total 22 prosecution witnesses to be examined.
I have heard the learned counsel for the parties and with their able assistance gone through the material available on record.
Keeping in view the period of incarceration of the petitioner, this court feels that there is no need to detain the petitioners any longer. Accordingly, the present petition is allowed. Petitioner is ordered to be released on bail during pendency of the trial of the present case, subject to their furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Tarn Taran.
