**** HARSIMRAN SINGH SETHI, J. (Oral) CWP-12342-2019 In the present petition, the prayer of the petitioner is that the respondents be directed to allow the petitioner to continue in service as Data Entry Operator on contract basis and his services should not be terminated. Learned counsel for the petitioner submits that while issuing notice of motion in the present petition, the co-ordinate Bench of this Court vide interim order dated 10.05.2019 has directed the respondents that the petitioner shall be allowed to continue in service and shall not be replaced by another contractual employee and he can only be replaced by regularly appointed employee subject to the condition that his work and conduct is satisfactory.

Learned counsel for the petitioner submits that the petitioner is

CWP-12342-201(O&M) & 22023:PHHC: 162437 &162487 already continuing in service under the interim order dated 10.05.2019 passed by the Co-ordinate Bench of this Court. Learned counsel for the respondents further submits that as the petitioner is already continuing in service, he will be allowed to continue in service on the post in question till the work of the said post exists but subject to his satisfactory work and conduct. Learned counsel for the respondents further submits that the petitioner will not be replaced by another contractual employee in the similar terms and conditions. Learned counsel for the respondents submits that in case the work on the post in question, does not exist, an appropriate order will be passed keeping in view the instructions issued by Government of Haryana Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present petition has been rendered infructuous, and the same may kindly be disposed of having been not pressed any further.

Ordered accordingly.

COCP-2095-2019 Learned counsel for the petitioner submits that the present contempt petition may kindly be disposed of having been not pressed any further.
