)/ Petition herein, inter alia, is for issuance of a writ in the nature of mandamus directing respondent No.2 to consider the candidature of the petitioner for the post of Clerk in EWS-Dependent of Ex Serviceman (Disability above 50% or killed)category.

Petitioner applied for the post of Clerk in EWS dependent of ExServiceman (Disability above 50% or killed) Category. He cleared the written examination and was called for scrutiny of documents on 27.05.2022. His category was changed to EWS by respondent No.2 then petitioner approached respondent No.2 but all in vain. He secured 54 marks in written + 5 marks for Socio Economic Criteria, therefore petitioner's score comes to 59, contends the learned counsel. Petitioner is claiming reservation in category Dependent of Ex Serviceman (Disability above 50% or killed), which has been denied by respondent No.2. Thereafter, petitioner gave application qua his aforesaid grievance but to no avail. Hence, the instant petition.

On advance service, learned State counsel appears and submits that a decision will be taken by competent authority, either way, on the application submitted by the petitioner by passing a speaking order. 4.
At this stage, learned counsel for the petitioner also seeks decision on the pending application, as suggested by learned State counsel. 5.
Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the instant writ petition is disposed of with a direction to the respondents to look into the application of the petitioner and pass an administrative order, in accordance with law, as expeditiously as possible but not later than finalization of the result. 7.
However, petitioner is at liberty to file representation in support of his earlier application.

Disposed of accordingly.
