**** JASJIT SINGH BEDI, J. (Oral) The prayer in the present petition under Section 528 BNSS is for quashing of the impugned order dated 27.11.2025 (Annexure P-5) whereby the petitioner was declared as a proclaimed person in FIR No. 05 dated 06.02.2019 u/s 406 IPC registered at PS NRI, District Kapurthala. On 16.04.2026, the following order was passed:- "The learned counsel for the petitioner contends that during the pendency of the present petition, the petitioner had filed a petition for quashing of the FIR No.5 dated 06.02.2019 (Annexure P-1) under Section 406 IPC (Section 316 BNS) registered at Police Station NRI, District Kapurthala. On account of the non-appearance of the counsel, the said petition was dismissed in default and subsequent thereto, the petitioner was declared a proclaimed person. He states that the petitioner is ready and willing to join the proceedings.

Subject to a deposit of Rs.2,00,000/- as costs with the Spinal Rehab Centre, Chandigarh, Plot No.1, Madhya VISHAL SETHI 2026.05.29 10:47 I attest to the accuracy and integrity of this document

CRM-M-19610-2026 -2Marg, Sector 28-A, Chandigarh, the operation of the impugned order dated 27.11.2025 (Annexure P-5) shall remain stayed.

The petitioner shall surrender before the concerned Court within a period of 04 weeks and seek the concession of bail, which shall be decided on its merits." In deference to the aforementioned order, the petitioner has deposited a sum of Rs.2,00,000/-, receipt thereof is taken on record. It is submitted that the petitioner has surrendered before the Trial Court and has been granted the concession of bail vide order dated 16.05.2026 passed by the Additional Chief Judicial Magistrate, Kapurthala. A copy of the said order is taken on record and marked as Mark 'A'. In view of the fact that the petitioner has already joined proceedings, the impugned order dated 27.11.2025 whereby the petitioner was declared a proclaimed person is quashed. The petitioner is directed to surrender his passport forthwith. He shall not leave the country without the permission of the Trial Court.

It is expected that the petitioner shall not absent himself from the Trial without sufficient cause.
