Prayer in this petition is for issuance of directions to respondents No.1 to 4 to conduct proper and fair investigation on the complaints given by the petitioner.

This petition is pending since 2016 and the reply by way of affidavit of Deputy Superintendent of Police, Sub Division, Kharar-I, District S.A.S. Nagar Mohali on behalf of the State has been filed today in the Court.

CRM-M-44528-2016 (O&M) -2CRM-M-44508-2016 (O&M) As per the reply, an enquiry was conducted on the complaints given by the petitioner by the Superintendent of Police (Headquarters), S.A.S. Nagar, Mohali by associating both the parties and recommendation was made for registration of an FIR against the Director, M/s GGP Buildtech Private Limited, namely, Ajay Gupta-respondent No.6 and also to vouch for the role of Rakesh Gupta-respondent No.7. Thereafter, Senior Superintendent of Police, S.A.S. Nagar, after taking opinion from the Deputy District Attorney (Legal), who opined that prima facie offence under Section 406/420 IPC is made out, recommended the case for registration of the FIR and, thereafter, FIR No. 20 dated 7.2.2020 under Sections 406/420 IPC stood registered and the same is now under investigation. In view of the same, no further action is called for and, therefore, the above mentioned two petitions, i.e. CRM-M-44528-2016 and CRM-M-44508-2016 are disposed of.
