The present revision petition has been filed under Article 227 of the Constitution of India, seeking a direction to the learned Civil Judge (Junior Division), Gurugram to decide the application for grant of adinterim injunction filed by the petitioners/plaintiffs in a time-bound manner. 2.

Learned counsel for the petitioners submits that the petitioners/plaintiffs have instituted a suit for declaration and permanent injunction against the respondents/defendants. It is further submitted that respondents/defendants No.4 and 5 had carved out plots, received the sale consideration, and handed over peaceful physical possession of the respective plots to the petitioners/plaintiffs and other purchasers after execution of written documents. It is further contended that defendants No.1 and 2, in collusion with defendant No.3, are attempting to raise a -1SHUBHAM 2026.04.10 12:08 I attest to the accuracy and authenticity of this document/order

CR-3140-2026(O&M) multi-storey construction over land comprised in khasra/raqba No. 4087/237 and 4090/239, situated on the western side of the houses and plots of the petitioners/plaintiffs. Learned counsel submits that unnecessary adjournments are being granted by the learned Trial Court, resulting in delay in adjudication of the application under Order 39 Rules 1 and 2 CPC. Accordingly, a limited prayer has been made for directing the Trial Court to decide the said application in a time-bound manner. 3.

I have heard learned counsel for the petitioners and perused the paper-book.

Considering the limited nature of relief sought, issuance of notice to the respondents is dispensed with, as the same would only result in further delay of the proceedings.

In view of the aforesaid, the present revision petition is disposed of without expressing any opinion on the merits of the case. The learned Civil Judge (Junior Division), Gurugram is directed to decide the application under Order 39 Rules 1 and 2 read with Section 151 CPC, pending in Civil Suit bearing No. CS-4049-2025 as well as in Civil Suit bearing No.CS-3634-2025, within a period of three weeks from the date of receipt of a certified copy of this order, in accordance with law. 6.

The Registry is directed to forward a copy of this order to the learned Civil Judge (Junior Division), Gurugram for compliance.
