The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 3 to issue her passport.

The petitioner vide application dated 06.01.2024 has applied for passport. An FIR No. 57 dated 30.06.2010, under Sections 409 of IPC and Section 13 (2) of Prevention of Corruption Act, 1988, was registered against her at Police Station, Fatehgarh Churain, District Gurdaspur. She was convicted vide judgment dated 30.07.2014 passed by Special Judge, Gurdaspur. She filed CRA-S-3472-SB of 2014 before this Court. CWP No.10199 of 2024 -23. Learned counsel for the petitioner submits that case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391. 4.

Mr. Aman Dhir, DAG, Punjab submits that it is factually correct that except in the aforestated FIR, the petitioner is not involved in any other offence.

Mr. Arnav Kumar Sood, Central Government Counsel for Union of India submits that petitioner may be directed to appear before passport authority alongwith judgment of conviction passed by trial court as well as order passed by this Court in CRA-S-3472-SB of 2014. The competent authority thereafter would pass an appropriate order, in accordance with law.

Counsel for the petitioner agrees to the aforesaid arrangement. 7.

In the wake of statement of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 11.06.2024 alongwith judgment of conviction passed by trial court as well as order passed by this Court in CRA-S- 3472-SB of 2014. On doing so, the passport authority would pass an appropriate order within eight weeks from 11.06.2024.
