By way of Civil Miscellaneous Application i.e. CM-6402-C2023, applicant-appellants are seeking withdrawal of main appeal i.e. RSA1500-2023. 2.

It has been averred in the application that the applicantappellants are unable to arrange the requisite court fee for affixing in the above said Regular Second Appeal (RSA), and besides this, due to some personal difficulties, they do not wish to pursue present appeal, and thus, seeks permission to withdraw the same.

In view of the averments made in CM-6402-C-2023, which is supported by an affidavit dated 15.05.2023 of applicant-appellant No.1, prayer made in the application is allowed and the applicant-appellants are permitted to withdraw present appeal. CM stands disposed of. 4.

Consequently, main appeal i.e. RSA-1500-2023 stands dismissed as withdrawn.
