Seeking setting aside of impugned judgment and order of sentence dated 02.09.2011 passed by Additional Sessions Judge, Faridkot whereby the petitioner was convicted while allowing the appeal of State, the petitioner has come up before this Court under Section 397, 399 r/w 401 CrPC.

State counsel on instructions submits that the petitioner has expired and has handed over death certificate of petitioner-deceased Devi Dayal which is taken on record. 3.

Given the factum of death of the petitioner, the main petition is disposed of as abated. Bail bonds and surety bonds furnished by petitioner-deceased stand discharged.
