**** HARNARESH SINGH GILL , J. (ORAL) Case is being taken up for hearing through video conferencing. The petitioner seeks regular bail in FIR No. 2 dated 7.1.2020 under Sections 21, 23 and 25 of the Narcotic Drugs and Psychotropic Substances Act, 1985, Sections 411, 414 and 120-B IPC and Section 25 of the Arms Act, 1959 registered at Police Station Gharinda, Amritsar Rural, District Amritsar.
Learned counsel for the petitioner submits that till date no recovery has been effected from the petitioner and challan has been presented. He further submits that co-accused Harpreet Singh, Jasbir Singh, Dildar Singh and Saraj Singh have been granted anticipatory bail whereas co-accused Sarvodya Rakesh Bahri has been granted regular bail by this Court. Learned counsel further states that petitioner has been in custody since 28.5.2020.

Custody certificate by way of affidavit of Deputy Superintendent, Central Jail, Amritsar dated 13.8.2020 has been filed through e-mail. Print out of the same is taken on record. As per the custody certificate, the petitioner has been in custody from the last 02 months and 08 days and no other case is pending against him. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars. Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
