In the present writ petition, the petitioner is praying for issuance of a direction to respondent No.2-Collector, Faridabad, to complete the recovery proceedings in recovery case No.149/20-21 titled 'C.A Cooperative T/C Society Ltd. Vs. Manish Kathuria and others', which was referred by respondent No.3 vide letter dated 16.07.2020 (Annexure P-5), in pursuance to Award dated 17.02.2020 (Annexure P-1) and the recovery certificate dated 20.03.2020 (Annexure P-3).

Learned counsel appearing on behalf of the petitioner submits that the recovery proceedings have been pending since 2020 and no decision has been taken thereon by respondent No.2.

Learned counsel, on instructions from the petitioner, submits that at this stage, petitioner will be satisfied if a direction is given to respondent No.2 to decide the recovery proceedings, in a time bound manner.

Mr. Gaurav Jindal, Additional A.G., Haryana, accepts notice on behalf of respondents No.1 and 2 and does not object to the prayer made by learned counsel for the petitioner.

In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to respondent No.2 to consider and decide recovery proceeding pending in recovery case No.149/20-21 titled 'C.A Co-operative T/C Society Ltd. Vs. Manish Kathuria and others' within a period of 04 months from the date of receipt of certified copy of this order.
