*** NIDHI GUPTA, J. (ORAL) Prayer in the present 1st petition under Section 482 of Cr.P.C. is for quashing of FIR No. 149 dated 28.11.2022 under Sections 363, 366 IPC registered at Police Station Division D, District Police Commissionerate, Amritsar (Annexure P-1) registered against the petitioner on the basis of Compromise dated 28.03.2024 (Annexure P-2) arrived at between the parties.

Status report dated 07.11.2024 filed by way of an affidavit of the Assistant Commissioner of Police, Central, Amritsar City, on behalf of respondent No.1-State of Punjab in Court today is taken on record. Vide last order dated 29.05.2024 passed by this Court, the petitioner had prayed that proclamation order dated 20.04.2024 be set aside and the petitioner be granted one opportunity to surrender before the learned trial Court within a period of 15 days i.e. on or before 12.06.2024. Learned counsel for the State has drawn attention of this Court to the averments mentioned in para 7 of the above said status report, wherein it is reiterated that as the petitioner had failed to comply DIVYANSHI 2024.11.12 15:57 I attest to the accuracy and integrity of this document

CRM-M-27178-2024 (O&M) - 2with the order dated 29.05.2024 and had also failed to surrender before the learned trial Court on or before 12.06.2024, the present petitioner has been declared Proclaimed person vide order dated 21.10.2024 passed by the Court of learned JMIC, Amritsar. The next date before the learned trial Court is 09.12.2024 for filing list of property of the petitioner under Section 83 Cr.P.C. and notice has also been issued to prosecution witnesses for the said date by the learned trial Court. It is also pointed out by learned counsel for the State that the petitioner had previously filed an application bearing No. CRM-312292024 in connected CRM-M-27635-2024, wherein the petitioner had sought extension of time and one more opportunity to surrender before the learned trial Court in pursuance of order dated 29.05.

2024 passed by this Court. The said application i.e. CRM-31229-2024 and the main petition i.e CRM-M-27635-2024 has been dismissed vide order dated 09.08.2024 in view of the fact that the petitioner had failed to surrender before the learned trial Court on or before 12.06.2024 and also failed to deposit costs of Rs.20,000/- as directed vide order dated 29.05.2024. Even today, there is no representation on behalf of the petitioner. In view of the facts as noticed above, the present petition stands dismissed.
