(ORAL ) The present petition has been filed under Section 439 of the Code of Criminal Procedure, seeking regular bail in FIR No.337 dated 13.6.2021, under Sections 147, 148, 149, 323, 341 and 506 IPC, 1860 registered at Police Station Bhiwani Sadar, District Bhiwani, Haryana Learned counsel for the petitioner has submitted that it is a case where six accused were named in the FIR including one Anurag and the entire allegations are pertaining to Anurag who had allegedly caused injuries to the injured by hitting him with iron rod on the legs causing fracture in both of them. He has submitted that so far as present petitioner is concerned, he was arrested on 29.6.2021 and although the matter is at the RAJ KUMAR ARORA 2021.07.20 17:24 I attest to the accuracy and integrity of this document

CRM-M-26585-2021 (O&M) investigation stage but there is no injury attributable to the petitioner even as per the contents of the FIR. He has submitted that no recovery is to be made from the petitioner and therefore, he may be considered for the grant of regular bail. He has referred to the anticipatory bail granted to the other 4 co-accused on the same fact in issue vide order dated 1.7.2021 (Annexure P3). On the other hand, learned State counsel has submitted that it is correct that the petitioner is in custody since 29.6.2021 and other 4 co-accused have been granted anticipatory bail by this Court vide Annexure P-3.

After hearing the learned counsel for the parties and considering the fact that the petitioner who has been arrested on 29.6.2021, is in custody since then and that even as per the FIR itself, the main role is attributable to another main co-accused namely Anurag, this Court deems it fit and appropriate to admit the petitioner on bail. Consequently, the present petition is allowed. It is ordered that the petitioners shall be released on bail on furnishing bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned.

However, anything observed hereinabove shall not be treated as an expression of opinion on merits of the case and is meant only for the purpose of decision of present petition. July 19, 2021.
