The instant petition has been filed by the petitioner under Section 439 of the Code of Criminal Procedure, 1973 seeking regular bail in case FIR No.176 dated 25.07.2024, under Sections 363, 366-A, 376, 376(2)(n), 376-D, 120-B IPC, 1860 and Section 6 of the Protection of Children from Sexual Offences Act, 2012, registered at Police Station Sadar Nabha, District Patiala (Annexure P-1). 2.

Learned State counsel has submitted copy of the DNA Report dated 31.10.2022, received from the Central Forensic Science Laboratory, Sector 36-A, Chandigarh, which is taken on record. Learned State counsel contends that the prosecutrix has specifically levelled allegations of sexual abuse against the petitioner. The said allegations are supported by the medical evidence i.e. DNA Report dated 31.10.2022.

After arguing for some time, learned counsel for the petitioner wishes to withdraw the present petition.

Accordingly, the present petition stands dismissed as withdrawn. 5.
