Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.58 dated 12.07.2016 under Sections 420, 120-B IPC and Section 24 of the Immigration Act, 1983, registered at Police Station Raikot, District Ludhiana. Notice of motion was issued and learned State counsel appeared and contested the petition.

Learned counsel for the petitioner argued that the petitioner being attorney of his brother Hari Singh had filed a complaint, copy of which is Annexure P-2 against son-in-law of present complainant Sarwan Singh and present false FIR has been got registered by the complainant due to that reason.

CRM No.M-44658 of 2016 -2I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the petitioner has already joined the investigation. He is not required for any custodial interrogation or investigation. Nothing is to be recovered from him. The trial of the case will take long time. No useful purpose will be served by sending the petitioner to custody till the disposal of the case. Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of grant of anticipatory bail. Therefore, the present petition is accepted and the order dated 15.12.2016 granting interim bail to the petitioner is made absolute.
