The petitioner was booked in a case of cheating and preparation of false documents in the year 2011 on the allegation that he had gone to UK on the basis of a passport issued in the name of Paramjit Singh.

Counsel for the petitioner has submitted that the name of the petitioner had been changed by adopting the due procedure prevalent under law and that he had not committed any act of cheating causing any wrongful loss to any one. The complainant, as claimed by the petitioner, is a Commission Agent in contact with Bhupinder Singh, who is running a travel and passport consultancy and has falsely implicated the petitioner in the present case.

I have heard counsel for the petitioner. The probable defence available with the petitioner, can always be raised before the trial court. Counsel for the petitioner has submitted that the petitioner has come all the way from UK to face trial and the delay in disposal of the case is causing serious prejudice to him.

Cr. Misc. M 44678 of 2016 and I am of the opinion that the prayer for disposal of the trial expeditiously is not an unreasonable request in the present case. Notice to AG Punjab. On asking of the Court, notice has been accepted by Ms. HK Athwal, DAG, Punjab. Copy given. The petition is disposed of with a direction that in case the petitioner moves an application for disposal of the trial explaining the circumstances that he has come all the way from UK and is in India for facing the trial, the trial court shall make an earnest endeavour to dispose of the trial within a period of three months after the date of filing of the application, after giving a fair opportunity to the petitioner to produce defence evidence.
