Versus
State of Haryana and another
...Respondent
CORAM:
HON'BLE MR. JUSTICE H.S. MADAAN Present:- Mr. Aditya Sanghi, Advocate for the petitioners. Mr. Neeraj Poswal, AAG, Haryana.
Mr. D.K. Singal, Advocate for respondent no.2. *** Learned counsel for the petitioners states that copy of NOC has already been placed on record of this petition by him as Annexure P11. He has supplied a copy thereof to counsel for respondent no. 2. Learned counsel for the respondent-complainant submits that petitioners be directed to produce the original of this NOC as the same would be required during trial. Counsel for the petitioners states that needful would be done at appropriate time. Since the petitioners have been summoned in a complaint case and have put in appearance there and there is no question of their custodial interrogation and sending the petitioners behind bars till disposal of the complaint is not going to serve any useful purpose, as such the interim bail granted to the petitioners on 20.11.2017 is made absolute, subject to their fulfilling conditions under Section 438(2) Cr.P.C. The petition stands allowed accordingly.
