The petitioner seeks the concession of pre-arrest bail in a case registered at the instance of Rajiv Singla alleging that the complainant and Buta Singh were hit by one car, followed by an attack with base ball bats, on the person of the complainant and others. The petitioner was named for the first time in the supplementary statement without attributing any specific injury on the person of the complainant.

On the instructions of HC Darshan Singh, learned State counsel informs that the petitioner has joined the investigation. It is not a case of custodial interrogation.

Accordingly, the petition is allowed and it is ordered that in case of arrest of the petitioners, he will be released on bail to the satisfaction of the arresting officer subject to the condition that he will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation.
