On the basis of shortage of 26055 bags in Morinda open godown, the petitioners have been booked in the present case on the basis of physical checking done.

Learned counsel for the petitioners has submitted that for the crop year 2015, excessive bags have been found in the godown, Markfed Branch at Ajitwal. The petitioners are Inspector and Sales Man, respectively, of five godowns. It has also been informed that on the basis of the alleged misconduct, departmental proceedings are still under progress. The petitioners have joined the investigation. Custodial interrogation does not appear to be necessary in the present case. It is not the case of the prosecution that on a particular day, date and time, these articles have been stolen by the petitioners themselves or in connivance with any other person. The petitioners having joined the investigation, can be granted the concession of pre-arrest bail.

The petition is allowed and it is ordered that in case of arrest of the petitioners, they will be released on bail to the satisfaction of the arresting officer subject to the condition that they will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation.
