Learned counsel for the petitioner submits that during the pendency of the present petition, one of the Annual Confidential Report of the petitioner has already been upgraded, hence, now the petitioner becomes entitled for the benefit of promotion to the post of IAS Cadre. Hence, the present petition may kindly be disposed of having been not pressed any further with liberty to the petitioner to approach the appropriate forum to avail appropriate remedy keeping in view the fact that the ACR of the petitioner stands upgraded during the pendency of the present petition. 2.
