(ORAL) Through instant petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in case FIR No.40 dated 09.07.2018 registered under Section 307 IPC and Section 27 of the Arms Act at Police Station Sanaur, Patiala.

According to the prosecution, in the day time of 09.07.2018, petitioner fired three shots i.e. two in the air and third aiming at respondent No.2-complainant, pellets of which hit his thigh. Learned counsel for the petitioner inter alia contends that petitioner is in custody since 11.07.2018. He has falsely been implicated. Injuries suffered by respondent No.2-complainant are simple in nature. Story concocted by the complainant is not supported by medical evidence. Conclusion of trial may take sufficient long time. -2CRM-M-44770 of 2018 On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail during pendency of trial, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
