RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner in a case arising from FIR No.65 dated 11.06.2018 registered under Section 22 of the Narcotic Drugs and Psychotrpic Substances Act, 1985 at Police Station City Budhlada, District Mansa.
According to the prosecution, on 11.06.2018, petitioner was apprehended with 15 vials of Onerex and 150 tablets of Carisoma without any permit or license Learned counsel for the petitioner inter alia contends that salt of Carisoma does not fall under the definition of prohibited drug. Alleged quantity recovered from the petitioner was 15 vials Onerex, which is marginally above the non-commercial quantity. Petitioner is in custody since 11.06.2018. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail during pendency of trial, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
