******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioners in case FIR No. 696 dated 14.11.2016 registered for the offence punishable under Section 306 of Indian Penal Code (for short 'IPC'), at Police Station Kalanaur, District Rohtak.

Heard.

Learned counsel for petitioners submits that Gulshan Kumar husband of Sonia (sister of petitioner No. 1 and daughter of petitioner No. 2) committed suicide on 13.11.2016. As per recital in FIR, his wife and two children were living with him at the relevant time. In the suicide note alleged to have been recovered from the dead body of the deceased, he had mentioned that he is committing suicide on being harassed by his wife, mother-in-law and brother-in-law.

The marriage of deceased with Sonia was solemnized on Jitender Kumar 2017.01.20 16:52 I attest to the accuracy and integrity of this document

CRM-M-44736 of 2016 -228.02.2000, who was having two children from this marriage. There was history of matrimonial discord and panchayats were also held. Keeping in view the above facts but without commenting upon merits of the case, this petition is allowed and order dated 15.12.2016 is made absolute till the presentation of challan, subject to the following terms:- (i) that petitioners shall make themselves available for interrogation by the police as and when required; (ii) that petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against them so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) that petitioners shall not leave India without the prior permission of the Court.

(iv) that the petitioners will seek regular bail on the presentation of challan in Court.
