RAMENDRA JAIN, J. (ORAL) Case has been taken up for hearing through video conferencing due to pandemic Covid-19.

Through this Civil Writ Petition under Article 226 of the Constitution of India prayer has been made for issuance of writ in the nature of certiorari for quashing impugned action of the respondents, fixing/taking the date of determination of eligibility i.e. 1st January. Having considered the submissions made by learned counsel for the parties on the aspect of the preliminary objections, which have been raised by the State of Haryana with regard to the maintainability of the present writ petition before this Court in the light of Section 14 of the Administrative Tribunals Act, 1985, the present petition is ordered to be transferred to the Central Administrative Tribunal, Chandigarh Bench, Chandigarh, forthwith.

-2CWP-11314 of 2020 This order is being passed keeping in view the urgency involved in the matter as the examination, in pursuance to the advertisement dated 20.06.2020 (Annexure P-6), is to be held by the Haryana Public Service Commission on 09.08.2020. This Court has also been informed that the Central Administrative Tribunal, Chandigarh Bench, works on Mondays, Wednesdays and Fridays.

The matter be, therefore, put up before the Central Administrative Tribunal, Chandigarh Bench, Chandigarh, today itself for consideration.

The Tribunal may also look into the aspect with regard to the interim relief, which has been prayed by the petitioner. Copy of this order be sent to the Central Administrative Tribunal, Chandigarh Bench, Chandigarh, along with copy of the writ petition, today itself.

Parties to appear before the Central Administrative Tribunal accordingly.
