Amol Rattan Singh, J Learned counsel for the petitioner has produced in Court today an order passed by a Coordinate Bench in CRM-M-30193 of 2019, on 24.07.2019, by which a co-accused of the petitioner, i.e. one Surinder Singh, has been admitted to bail essentially on two grounds; first, that the FIR itself was registered 4 years and 9 months after the death of the husband of the complainant; and further, that out of the 20 prosecution witnesses, only 5 have been examined, with the petitioner in that case having been behind bars for the last 8 months.

Crl. Misc. No.M-21827 of 2019 [2] He further points out that the petitioner herein was also not named specifically in the FIR, with him being in custody since 16.11.2018. That being so, in the aforesaid circumstances, the petition is allowed and the petitioner is ordered to be released on bail to the satisfaction of the trial court, during pendency of the trial.
