ARVIND SINGH SANGWAN J. (Oral) Prayer in this petition is for issuance of direction to the First Appellate Court to decide the application filed by the petitioner under Section 391 Cr.P.C. (Annexure P4) separately, before deciding the main appeal.

Counsel for the petitioner has referred to the order dated 25.03.2019 and submits that the Lower Appellate Court has observed that the application under Section 391 Cr.P.C. will be decided along with the main appeal.

It is premature to say that what is in the mind of the Lower Appellate Court as it is expected that the Lower Appellate Court will decide the application under Section 391 Cr.P.C. in accordance with the well settled principle of law.

In view of the above, this petition is disposed of. It will be open for the Lower Appellate Court to decide the application under Section 391 Cr.P.C., in accordance with the well settled principle of law.
