(Oral) By filing the present petition, under Section 439 of the Code of Criminal Procedure, the petitioner has sought regular bail in FIR No.39 dated 21.06.2015, registered under Sections 363, 366-A, 376 read with Section 34 of IPC and Section 4 and 8 of POSCO Act, at Police Station Rawalpindi Phagwara, District Kapurthala.

It is contended that the incident pertains to 14.06.2015 whereas the FIR was lodged on 21.06.2015. There is no specific attribution against the petitioner in the initial version recorded under Section 161 Cr.P.C., made by the prosecutrix. The complainant and the prosecutrix have been examined. On the other hand, the learned State counsel states that out of total 13 PWs, 11 PWs have been examined and the remaining witnesses have been summoned for 03.02.2017. Keeping in view the fact that the trial is at the fag end, this Court is not inclined to go into the merit of the case. Dismissed.

However, considering the fact the petitioner is in custody since 21.06.2015, the trial Court is directed to conclude the trial expeditiously preferably within three months from today.
