The petitioner had been granted the concession of interim bail on 1.7.2015. On receipt of report of Chemical Examiner, he had been sent to custody again on 19.1.2016. The petitioner claims that he having not misused his liberty, may be granted the concession of bail. Merely because the petitioner has enjoyed interim bail for a long duration without commission of any further offence, is not sufficient enough to grant the concession of regular bail to him in a case of recovery of commercial quantity of Codiene Phosphate . No ground is made out to grant the concession of regular bail to the petitioner. Dismissed. However, it is ordered that in case the trial is not concluded within a period of six months after the next date of hearing fixed before the trial court, the trial court would be entitled to release the petitioner on bail on his furnishing bail / surety bonds to its satisfaction, in case any application is moved by him.
