Petitioner has sought a direction to stay the proceedings pursuant to FIR No. 258 dated 24.09.2013 till the conclusion of the complaint case titled as "Jagga Singh vs. Jeeto Kaur @ Jeeto Bail & ors." pending in the court of Judicial Magistrate Ist Class, Ellenabad. Only grievance of the petitioner is that issues in both the cases are overlapping. Thus, necessary direction be given. He has relied upon judgment reported as State of M.P. vs. Mishrilal (Dead) & ors. 2003(3) RCR (Criminal) 287.

I find no reason to interfere. Admittedly, the case pursuant to registration of FIR is at the stage of culmination and judgment is about to be pronounced. Trial pursuant to complaint is still pending and may take some time to reach its final stage. Judgment in Mishrilal's case (supra) relied upon by the petitioner is not applicable to the facts of this case. Petition is, thus, without any merit and is hereby dismissed.
