**** HARSIMRAN SINGH SETHI , J. (ORAL) Counsel for the petitioner argues that petitioner, who retired on 31.03.2006, is being granted the pension which is less than the minimum of the Grade Pay + Basic Pay of the post of Inspector, which he was holding at the time of his retirement.

Counsel for the petitioner states that minimum basic pay of Inspector is Rs.13,130/- and Grade Pay is Rs.3,300/- and if the minimum of basic pay and grade pay are added, petitioner is entitled to the pension of more than Rs.8,000/-, whereas he is being paid about Rs.7,800/- as pension which is contrary to the law.

Counsel for the petitioner states that for the relief which has been claimed in the present writ petition, petitioner has served the respondents with a legal notice dated 25.02.2019 (Annexure P-4), which is still pending consideration with the respondents and the petitioner will NARESH KUMAR 2019.07.15 17:10 I attest to the accuracy and integrity of this document Chandigarh

In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 25.02.2019 (Annexure P-4) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. Present writ petition stands disposed of.
