Vide this petition, the petitioner seeks the concession of 'regular bail' under the provisions of Section 439 of the Cr.P.C., upon FIR no.42, dated 03.04.2021, having been registered at Police Station City Bareta, District Mansa, alleging therein the commission of offences punishable under Sections
458, 308, 323, 427, 506, 148 and 149 of the IPC (with Sections 307 and 325 of the IPC added later and Section 308 deleted later). Learned counsel for the petitioner other than arguing on merits, submits that with 3 co-accused who have been attributed similar or 'greater' roles than the petitioner, having been admitted to bail now by the trial court itself, the petitioner also deserves the same concession, he having been in custody now for 8 months, with the trial still not progressing. Upon query to learned State counsel, he submits that the charge is still to be framed and that there is no other criminal case registered against the petitioner.
That being so, though counsel for the complainant opposes the petitioner being admitted to bail, 7&
