NIRMALJIT KAUR, J. (ORAL) Prayer in the present petition is to set aside the order dated 19.01.2019 passed by Sub Divisional Judicial Magistrate, Nihal Singh Wala, Annexure P-8, whereby the petitioners were declared proclaimed offenders in FIR No.138, dated 28.12.2017, under Sections 452, 323, 34 IPC, registered at Police Station Badhni Kalan, District Moga. It is contended that the matter had been compromised and, therefore, the petitioners thought that nothing survives in the said FIR. They were never aware of the pendency of the said case nor they received any notice till such time the non-bailable warrants were issued. Issue notice of motion.

Mr.H.S.Sullar, DAG, Punjab, accepts notice on behalf of respondent No.1.

CRM-M-21848-2020 -2Learned counsel for the petitioners states that the petitioners undertake to appear before the concerned Court/Illaqa Magistrate/Duty Magistrate within one week from today.

In case the petitioners surrender themselves within one week from today, they shall be released on bail on furnishing bail bonds and surety bonds to the satisfaction of the concerned Court/Illaqa Magistrate/Duty Magistrate.

In case the petitioners surrender, as above, the impugned order shall not survive. However, in case the petitioners do not appear within one week from today, the trial Court shall proceed in accordance with law. Disposed of accordingly.
