In the present petition, the petitioner is praying for issuance of a writ in the nature of Certiorari for quashing the order dated 17.12.2012 (Annexure P-1) passed by respondent No.2, vide which the petitioner was discharged from service on the ground that his services were no longer required.

Learned counsel appearing for the petitioner submits that the petitioner was discharged from service on account of FIR No.134 dated 07.09.2012, registered against the petitioner under Sections 323, 498-A, 406 and 506 of the Indian Penal Code, 1860. He further submits that the petitioner has since been acquitted by the Competent Court in the said FIR vide DIWAKER GULATI 2026.04.28 17:08 I attest to the accuracy and integrity of this document

CWP-12540 of 2021 (O&M) 2 judgment dated 16.05.2015 (Annexure P-2) and, as such, he is entitled to be re-enrolled/reinstated in service.

Learned counsel for the petitioner, on instructions from the petitioner, submits that at this stage, he will be satisfied if a direction is given to respondent No.2 to treat the present writ petition as a representation and decide the same, in a time bound manner.

Learned counsel for the respondents does not oppose the prayer made by learned counsel for the petitioner.

In view of the above and without commenting upon the merits of the case, the present petition is hereby disposed of with a direction to respondent No.2 to treat the present writ petition as representation and consider and decide the same, within a period of two months from the date of receipt of certified copy of this order, in accordance with law. 6.
