Bhandari, AAG, Punjab ***** SANJEEV PRAKASH SHARMA, J (ORAL) This is a petition filed under Section 439 Cr.P.C. for seeking regular bail in FIR No.0251 dated 31.08.2022 registered under Section 323, 342, 506 IPC, Section 376 IPC added later on registered at Police Station City Kharar District SAS Nagar, Mohali.

Learned counsel for the petitioner has submitted that the petitioner and the prosecutrix have been living together for almost 10 years and thereafter when the petitioner wanted to get married to the prosecutrix she has refused and such a statement has been made in the FIR. Learned counsel for the petitioner further submits that no case of rape can be said to be made out and the police has wrongfully added Section 376 later on. The petitioner was already granted bail earlier by the Police itself.

CRM-M-23153 of 2023 -22023:PHHC:068778 Keeping in view thereto and after hearing the learned State counsel, I am inclined to allow bail to the petitioner subject to furnishing of bail bond with a surety of Rs.20,000/- of the like amount. Accordingly, the petition stands allowed.
