In the present writ petition, the petitioner has challenged the order dated 11.06.2024 (Annexure P-4) passed by respondent No.4 to an extent that the petitioner has been denied salary for the intervening period from 01.10.2004 to 11.06.2024.

Learned counsel appearing on behalf of the petitioner submits that once the petitioner has been exonerated in the enquiry, there is no justification for denying him the salary for the period from 01.10.2004 to 11.06.2024, i.e., from the date of dismissal till reinstatement in service. 3.

Learned counsel for the petitioner further submits that although the impugned order was passed on 11.06.2024 (Annexure P-4), the petitioner thereafter, has filed a representation wherein, he has given details of similarly situated persons who have been granted the salary from the date of RIMPAL RANI 2026.04.10 16.56 I attest to the accuracy and integrity of this document

their dismissal till reinstatement on account of exoneration in the departmental proceedings/criminal proceedings. 4.

Learned counsel, on instructions from the petitioner, submits that at this stage, petitioner will be satisfied if a direction is given to respondent No.4 to decide the representation dated 25.11.2024 (Annexure P8) submitted by the petitioner in light of the orders dated 02.06.2020 (Annexure P-5) and 26.05.2025 (Annexures P-6 and P-7), in a time bound manner.

Mr. Rohit Ahuja, DAG, Punjab, accepts notice on behalf of respondents and does not object to the prayer made by learned counsel for the petitioner.

In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to respondent No.4 to consider and decide the representation dated 25.11.2024 (Annexure P-8), submitted by the petitioner as per law, in light of the orders dated 02.06.2020 (Annexure P-5) and 26.05.2025 (Annexures P-6 and P-7), within a period of 03 months from the date of receipt of certified copy of this order in accordance with law.
