"Petitioners seek anticipatory bail in FIR No. 29 dated 21.01.2026 under Sections 85, 316(2), 351(3) Bharatiya Nyaya Sanhita, 2023, Police Station City Barnala, District Barnala, Punjab. This is the first petition for anticipatory bail.

Learned counsel for the petitioners submits that marriage of son of petitioners and the complainant was solemnized on 09.03.2023. One month after the marriage, petitioners' son left for Australia and the complainant followed him after 6 months. One child was born out of the wedlock. The couple remained in Australia till 20.12.2025 whereafter they returned to India. The complainant happily left for her parents with her luggage and after 2 days, got the FIR registered alleging demand of dowry, cruelty etc. Allegations against the petitioners were vague and general and there was no question of petitioners demanding dowry as the couple was not residing with them. He further submits that the Court of learned Additional Sessions Judge had ordered release of the petitioners on interim bail however, the order was not made absolute on the ground that the petitioners did not get recovered passport and medical documents of the complainant. He undertakes that petitioners would cooperate in preparation of new documents and were ready and willing to join investigation.

Notice of Motion.

Mr. Kunwarbir Singh, AAG Punjab, accepts notice on behalf of Respondent-State and opposes the prayer for anticipatory bail. In the facts and circumstances of the case, petitioners are directed to appear before the Investigating/Arresting Officer and join investigation within one week or as and when required. In the event of their arrest, the Investigating/Arresting Officer shall release the petitioners on interim anticipatory bail on furnishing personal/surety bonds to his/her satisfaction. The petitioners shall also abide by the conditions as envisaged under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.

State is directed to file status report on 13.05.2026." (
