Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 331 dated 1.10.2015, registered under Section(s) 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985 at Police Station Focal Point, District Ludhiana City. Learned counsel for the petitioner contended that petitioner was earlier admitted to bail in this case and has been regularly appearing before the learned trial Judge. However, on 30.10.2017, he could not appear before the learned trial Court because of some urgency, otherwise there was no reasons for his non-appearance and his bail bonds were cancelled. Learned counsel further contended that petitioner is not involved in any other case and he is ready to furnish fresh bail bonds.
Having considered the submissions made by learned counsel for the petitioner, the present petition is disposed of with direction that petitioner shall appear before the learned trial Judge on or before the date fixed and Deepak Kumar Bhardwaj 2017.11.21 12:57 I attest to the accuracy and integrity of this document
Criminal Misc. No. 44031 of 2017 move an application for fresh bail. The learned trial Judge shall consider his application sympathetically and admit him to bail with two sureties of heavy amount. However, the learned trial Court shall be at liberty to complete the proceedings under Section 446 Cr.P.C.
