(ORAL) The present petition has been filed under Section 482 of Code of Criminal Procedure praying for issuance of a direction to respondent Nos. 1 & 2 to take appropriate action on account of the FIR No. 109 dated 23.10.2016, under Sections 376, 342, 323, 120-B IPC that was lodged at Women Police Station, Yamuna Nagar.

Learned counsel for the petitioner contends that statement under Section 164 Cr.P.C of the petitioner has been recorded but in spite of that police is skipping of the matter and is not investigating the same fairly. Heard.

However, petitioner is having alternative remedy to approach the Illaqa Magistrate under Section 156(3) Cr.P.C. for getting an FIR registered if any cognizable offence is made out as has been held by Hon'ble Apex Court in Sakiri Vasu v. State of U.P., 2007(5) Law Herald (Supreme Court) 3910.
