DAILY LOK ADALAT BENCH NO.3 CWP-6934-2005 RAMESH V/S PRESIDING OFFICER & ORS.

Present:
None.
* * * * SarvSh. Sachin Sood and Deepak Chawla, Advocates, who filed this writ petition, have not put in appearance in spite of notices. Notice issued to the petitioner has been received back unserved with the report "no such person is residing at the given address." The workman approached the Labour Court that his services have wrongly been terminated. The Labour Court recorded a finding that despite sufficient opportunities granted to the workman, he did not adduce any evidence to prove this case and as such his evidence was closed by order. The Labour Court also noticed that the workman had not worked for 240 days during the previous year and therefore, declined the reference. It was this order that was challenged by the workman. Since none has put in appearance in spite of notices, the record of this writ petition is ordered to be consigned to record. Liberty is, however, granted to the petitioner to get it revived, if need be.
