Naresh Kumar Sanghi, J.(Oral) Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioners, namely, Sukhdev Singh Dhillon and Mohinder Singh, who have been booked for having committed the offences punishable under Sections 294, 323 and 354 read with Section 34, IPC, in a case arising out of FIR No.125, dated 28.10.2014, registered at Police Station, NRI Cell, Ludihana.
Learned counsel contends that to save herself from DDR No.32, dated 28.10.2014, lodged by the petitioner-Sukhdev Singh with regard to beatings caused to him by the informant of this case a false FIR was lodged by the informant. He further contends that the allegations levelled by informant are SEEMA RANI 2015.02.10 17:22 I attest to the accuracy and authenticity of this document Chandigarh
Criminal Misc.No.M-44138 of 2014 {2} improbable while the version narrated by petitioner No.1 in his DDR, reproduced at page 3 of this paper-book is most natural. Nothing is to be recovered from the petitioners. They are neither required nor involved in any other case. He further contends that in compliance of the order dated 24.12.2014 passed by this Court, the petitioners have joined the investigation.
Learned counsel for the State, on instructions HC Gurmail Singh, Police Station, NRI Cell, Ludhiana, very fairly concedes that the petitioners have joined the investigation and further custodial interrogation of the petitioners is not required in the present case.
In view of the above, the present petition is allowed and the interim directions issued by this Court vide order dated 24.12.2014 are made absolute.
The petitioners shall continue to join the investigation as and when required to do so and abide by all the conditions laid down under Section 438(2), Cr.P.C.
