Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.72 dated 16.11.2016 under Sections 420, 406 and 120-B IPC, registered at Police Station Sandaur, District Sangrur.

Notice of motion was issued and learned State counsel as well as learned counsel for the complainant appeared and contested the petition. From the record, I find that the allegation against the present petitioner Nitin Goyal is that he entered into agreement to sell and `10 lacs was paid to him but he did not execute the sale deed and later on, he sold Vineet Gulati 2017.02.09 17:16 I attest to the accuracy and authenticity of this document Chandigarh the plots in favour of Gurmail Singh.

CRM No.M-44976 of 2016 -2The petitioner has joined the investigation. He is not required for any investigation or interrogation purposes. The case is based on documentary evidence. The main dispute looks like of civil nature. The trial of the case will take long time. No useful purpose will be served by sending the petitioner to custody till the disposal of the case. Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of grant of anticipatory bail. Therefore, the present petition is accepted and the order dated 16.12.2016 granting interim bail to the petitioner is made absolute.
