(ORAL) The present writ petition pertains to withholding of retiral benefits of the petitioner on account of pendency of departmental proceedings.

Counsel for the petitioner refers to chargesheet issued vide memo dated 18th of May, 2017 (Annexure R-1/T) appended along with written statement filed by respondent No.1 and 2 through Rakesh Kumar, Joint Secretary to submit that the amount at the most that can be claimed from the petitioner will be 1,77,030/- and thus he will be entitled for rest of the retiral benefits.

Mr. Kang however claims that during the pendency of the inquiry proceedings the acceptance of the prayer made by the petitioner DEEPAK KUMAR 2023.02.24 10:23 I attest to the accuracy and integrity of this document

CWP-11336-2020 -2today would amount to pre-judging the whole issue. I have heard counsel for the parties and have gone through the records of the case.

Admittedly, as on date only one departmental inquiry is pending against the petitioner and there is no more contemplated in pipeline. Resultantly, the present writ petition is disposed off with the direction to the respondents to conclude the pending inquiry against the petitioner within a period of 3 months from the date of receipt of certified copy of this order.

The claim of the petitioner for retiral benefits will obviously abide by the result of such inquiry.
