M.M.S. BEDI, J (ORAL) Petitioner seeks concession of pre-arrest bail in a case registered at the instance of District Revenue Officer-cumConsolidation Officer alleging that on the basis of bogus documents mutations were entered in favour of purchasers who were shown as owners of the land in village Rozqa Gujjar.
Counsel for the petitioner has contended that mutation entries have been made by the petitioner during the course of official duties, as such the requisite sanction has not been obtained. He has also submitted that as per Annexure P1, the enquiry into the alleged wrong mutation was ordered by the revenue authorities but before report could be received the present case has been registered.
I have heard the learned counsel for the petitioner
CRM-M-44168-2014 (O&M) and gone through the police record. It is an admitted fact that on the basis of the mutation no right has been vested in any person not entitled to the property and the mutation stands cancelled. In view of petitioner having joined investigation and taking into consideration the said circumstance, the petitioner can be granted the concession of pre-arrest bail.
Petition is allowed. Interim order dated 24.12.2014 is hereby made absolute subject to the conditions that he will join investigation as and when required and will not tamper with the evidence or hamper investigation, in any manner. (M.M.S. BEDI) February 4, 2015.
